These terms are the agreement between you and MHD Inc. Ltd ("Brevona", "we", "us") for the use of Brevona. Please read them before you create an account. By creating an account, starting a free trial or paying for a plan, you accept them.
1. Who these terms apply to
Brevona is software for businesses: cafés, restaurants, bakeries, food trucks, shops and similar venues ("Stores"). These terms apply to the person or business that creates an account ("you"), and to anyone you invite to work in your account, such as managers, cashiers and kitchen staff ("Staff").
The people who open your menu, place orders or join your loyalty programme are your customers ("Guests"). Guests do not need an account and these terms do not create an agreement between Brevona and your Guests. Your relationship with your Guests is your own.
If you accept these terms on behalf of a business, you confirm that you are allowed to bind that business. You must be at least 18 years old.
2. What Brevona does
Brevona (the "Service") includes, depending on your plan:
- a digital menu for each Store, opened by Guests from a QR code or link at brevona.com/<your-store>;
- orders from tables, at the counter and by WhatsApp;
- a point-of-sale (POS) screen, a kitchen display, tables, stock tracking and reports;
- loyalty cards for Guests, including Apple Wallet and Google Wallet passes;
- staff accounts, roles and several Stores in one account;
- support for receipt printers and barcode scanners that work with a web browser.
We improve the Service all the time. We may add, change or remove features. If we remove a feature that is a main part of a plan you have paid for, we will tell you in advance and, if you ask, refund the unused part of that plan.
3. Your account
- Give us accurate information and keep it up to date, in particular your email address. We use it for sign-in, invoices and important notices.
- Keep your password safe. You are responsible for everything done in your account, including by your Staff. Remove Staff accounts when people stop working for you.
- Tell us straight away at support@brevona.com if you think someone has used your account without permission.
- You may sign in with Google, Apple or Facebook where offered. Their own terms apply to that sign-in.
4. Free trial
New accounts get a free trial of 14 days. No payment card is needed. During the trial you can use the features of the plan shown in your account. When the trial ends, the paid features stop until you buy a plan. Your menu, settings and data are kept, so you can continue where you left off.
We may change the length of the trial for new accounts or end trials that are being misused (for example, opening many trial accounts for the same business).
5. Plans, prices and payment
- Plans are per Store and per year. The current plans and prices are on our pricing section and in your account. Prices are in US dollars unless your checkout shows another currency, and do not include taxes such as VAT or sales tax, which are added where they apply.
- Payment. Payments are processed by Stripe. We do not see or store your full card number. By adding a payment method, you authorise us to charge it for your plan and its renewals.
- Automatic renewal. Plans renew automatically at the end of each paid year at the price then in force, unless you turn off renewal in your account before the renewal date. We will remind you by email before a yearly renewal.
- Price changes. If we change the price of your plan, we will tell you at least 30 days before your next renewal. The new price applies from that renewal. If you do not agree, turn off renewal before that date.
- Failed payments. If a payment fails, we will try again and tell you. Your plan keeps working for a grace period of 3 days. After that, paid features stop until the payment is made. Your data is kept.
- Extra Stores and add-ons (for example an additional Store or the POS) are billed in the same way as plans.
- Refunds are explained in our Refund Policy.
6. The Brevona Counter Set (devices)
The Counter Set is a bundle of devices (a tablet, a barcode scanner and a receipt printer, with stands) and the first year of the Menu + POS plan for one Store. After the first year, the software renews at the yearly price shown when you ordered.
- Ordering and delivery. We confirm each order, its total and the delivery date with you before payment. Delivery times are estimates. Customs duties and import taxes, where they apply, are payable by you unless we agree otherwise in writing.
- Ownership and risk. The devices become yours when they are paid for in full. Risk of loss or damage passes to you on delivery.
- Warranty. Devices come with the manufacturer's warranty for 12 months from the delivery date, against manufacturing defects. You claim it through us: we arrange the repair or replacement with the manufacturer. The warranty does not cover damage from accidents, liquids, drops, misuse, unauthorised repair or normal wear (such as print heads and batteries). Full details are in our Hardware Warranty and Delivery Policy.
- Returns. Devices can be returned only if they arrive damaged or are faulty. We do not take back working devices because of a change of mind. See our Refund Policy.
- The devices also work with other software. The software year included in the bundle is tied to one Store and cannot be exchanged for cash.
7. Your content and your Guests
You own your content. Your menu, prices, photos, logos, descriptions, Store details and the data your Store collects ("Your Content") belong to you or your licensors. You give us a worldwide, non-exclusive licence to host, copy, display and process Your Content only as needed to run the Service for you, including showing your public menu to Guests. This licence ends when Your Content is deleted from the Service, except for copies in backups, which are overwritten in the normal course.
You are responsible for your Store. In particular:
- the accuracy of your menu, prices, taxes, service charges, availability, allergen and dietary information, and any other information the law requires you to show;
- the sale of age-restricted products, such as alcohol or tobacco, where it is allowed;
- the orders you accept, the food and goods you supply, and any disputes, refunds or complaints from your Guests;
- taking payment from your Guests. Guests pay you directly; Brevona does not collect or hold money for your sales and takes no commission on them;
- having the rights to the photos, names and logos you upload.
Guest personal data. When your Store collects Guest information (for example names and phone numbers for WhatsApp orders or loyalty cards), you are the controller of that data and we process it for you, as described in our Privacy Policy. You must have a lawful basis for collecting it and tell your Guests how you use it.
Tax and fiscal rules. Brevona is not a certified fiscal cash register or tax device. In countries where sales must be recorded with a certified fiscal device or reported to a tax authority, you remain responsible for doing so. Receipts printed from Brevona are not tax invoices unless your local rules say they are.
8. Acceptable use
You must use the Service lawfully and follow our Acceptable Use Policy. In short: no illegal products or content, no misleading menus, no spam, and no attempts to break, overload or copy the Service.
9. Store addresses
Each Store gets a web address such as brevona.com/your-store. The address is part of the Service and is not property you own. We may refuse, change or take back an address that:
- infringes someone else's trade mark or name, or impersonates another business;
- is misleading, offensive or reserved for our own use (for example dashboard, admin or support);
- belongs to an account that has had no paid plan or active trial for more than 12 months.
Where possible we will tell you first and keep the old address redirecting to the new one for a reasonable time.
10. "Powered by Brevona"
Public menus, loyalty pages and receipts show a small "Powered by Brevona" mark with a link to our website. You may not hide or remove it unless your plan includes that option.
11. Other services
Some features use services from other companies, such as Stripe (payments), Google and Apple (sign-in and wallet passes), Meta (WhatsApp and Facebook sign-in) and the makers of your devices. Your use of those services is also governed by their terms. We are not responsible for those services, but we choose them with care and will help you with problems where we can.
12. Availability and support
We work to keep the Service available at all times, but we do not promise that it will never be interrupted or error-free. We may need to carry out maintenance, which we try to schedule at quiet times. The Service needs a working internet connection on your devices.
Support is available by email at support@brevona.com and by WhatsApp, in English, Arabic and Turkish. We aim to reply within one working day. Specific response times or service levels apply only if we agree them with you in writing.
13. Our intellectual property
The Service, its software, design, logos and the Brevona name belong to us or our licensors. These terms give you a right to use the Service while your account is active; they do not transfer any ownership. You may not copy, resell, rent, reverse engineer or build a competing product from the Service, except where the law allows it despite this restriction.
If you send us ideas or feedback, we may use them without any obligation to you.
14. Ending your account
By you. You can turn off renewal at any time; your plan then stays active until the end of the paid period. You can also delete your account from your account settings. Deleting your account cancels its subscriptions.
By us. We may suspend or close an account, with notice where reasonable, if:
- you seriously or repeatedly break these terms or the Acceptable Use Policy;
- payment is overdue after the grace period;
- we must do so by law, or to protect Guests, other customers or the Service.
We may also stop offering the Service altogether by giving at least 90 days' notice and refunding the unused part of prepaid plans.
Your data afterwards. Before or within 30 days after your account ends, you can ask us for a copy of your menus, customers and orders in a common format. After that, data is deleted as described in our Privacy Policy.
15. Disclaimer
Apart from the promises made in these terms, the Service is provided "as is" and "as available". To the extent the law allows, we exclude all other warranties and conditions, including that the Service will meet a particular purpose. You are responsible for checking that the Service is suitable for your business, and for keeping your own records where the law requires them.
16. Our liability
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
- We are not liable for loss of profits, sales, business, goodwill or data, or for any indirect or consequential loss.
- Our total liability to you for all claims in any 12-month period is limited to the amount you paid us for the Service in that period.
- We are not responsible for delays or failures caused by events outside our reasonable control, such as internet or power failures, failures of third-party providers, natural events or government action.
17. Your responsibility to us
You will cover our reasonable costs and losses arising from claims by third parties (including your Guests and authorities) that result from Your Content, your products, your dealings with Guests, or your breach of these terms or the law.
18. Changes to these terms
We may update these terms, for example when we add features or when the law changes. We will publish the new version on this page with a new "last updated" date. If a change materially affects you, we will tell you by email or in your account at least 30 days before it applies. If you keep using the Service after that date, the new terms apply. If you do not agree, you can turn off renewal and delete your account.
19. General
- These terms, together with the policies linked from them, are the whole agreement between you and us about the Service.
- If any part of these terms cannot be enforced, the rest remains in force.
- If we do not enforce a right straight away, we can still enforce it later.
- You may not transfer your account to someone else without our agreement. We may transfer our rights and obligations to a company that takes over the Service, and will tell you if we do.
- These terms are written in English. Translations are provided for convenience; if there is a difference, the English version applies.
20. Law and disputes
These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction over any dispute, except that, where the law of your country gives you a right to bring a claim locally, that right is not affected. Before starting any claim, please contact us so that we can try to resolve the problem.
